If we see around we can realize that due to shift to welfare state, there has been increase in the administrative functions of the country. After independence there was a lot of confusion regarding delegation of legislative power to the executive. To clarify this: the president under article 143 of the constitution referred the matter to the apex court and it laid down certain guidelines clarifying the position. The Article analyses the Bombay High Court recent ruling namely Commissioner of Income Tax vs. Bharat R. Ruia (HUF) (MANU/MH/0535/2011) pertaining to issue as to whether the transactions in exchange traded financial derivatives are “speculative transactions” as defined in Section 43(5) of the Income Tax Act, 1961 and if so whether clause (d) inserted to the proviso to Section 43(5) of the Act w.e.f. 1st April, 2006 would apply to such transactions undertaken in the assessment year 2003-04 relating to speculation transaction.
